Terms and conditions

These conditions are agreed between GRACE LIFE, UNIPESSOAL LDA, with the tax identification number 516979566, Avenida Rei Humberto II of Italy, no. 17, 4º D42 2750-642 Cascais, with the email address [email protected], hereinafter referred to as GRACE LIFE and between any person, singular or collective, who wishes to make purchases through the website, hereinafter referred to as “Customer”. The purchase of E-Commerce products in the GRACE LIFE Online Store is subject to the following terms and conditions:

1. Subject

1.1 These General Conditions in force are intended, with the order form, and the other elements referred to therein, to regulate the terms and conditions under which the provision of the Service will be governed in the GRACE LIFE Online Store.

1.2 The purchase of any product in the GRACE LIFE Online Store implies acceptance of these General Conditions of Sale Online.

1.3. Access to the GRACE LIFE Online Store is free of charge and does not require prior subscription or registration of the user.

1.4 Alcoholic beverages available for sale in the GRACE LIFE Online Store may only be purchased by individuals who are of legal age in their country of residence.

2. Product Information, Prices and Content

2.1 GRACE LIFE reserves the right to modify, without notice and at any time, the information and commercial offer presented about: products, prices, promotions, commercial conditions and services.

2.2 Images illustrating each product in GRACE LIFE may differ from the product subsequently delivered.

2.3 Items for sale in the GRACE LIFE Online Store are subject to existing stock and orders will be processed on a first-come, first-served basis. In case of stock rupture, temporary or permanent, the Customer will be duly advised, being suggested an alternative of products with similar characteristics.

2.4 Under Portuguese law, the prices of the products are indicated in € (euros) and include VAT at the legal rate in force, as well as the cost of packaging. The shipping cost for the Customer is not included.

3. Order and payment

3.1. To make a purchase in the GRACE LIFE Online Store, you must register as a Customer. Once registered, the user can place their order by selecting the desired products. You must follow all the steps described in it, for the order to be completed successfully.

3.2 After confirming the order in the GRACE LIFE Online Store, you must select the payment method you want, among the available options Visa, Mastercard, bank transfer (insert others if any). Any order placed in the GRACE LIFE Online Store will only be processed upon receipt of the payment. The formalization of the order itself does not constitute a reservation of the products.

3.3 After the order is confirmed in the GRACE LIFE Online Store, an email will be sent to the contact address registered thereby the Customer at the time of formalization, with all the details about delivery, billing, and payment information. If the Customer does not receive the order confirmation email, they are asked to contact GRACE LIFE via the email [email protected].

3.4 Changes to the conditions of unshipped orders or cancellation of an unshipped order may be made when requested by email [email protected].  

3.5 Orders placed by users from countries outside the European Union must be validated in advance.

3.6 Orders will only be shipped after confirmation of stock and payment and will be processed on a first-come, first-served basis.

3.7 Orders placed during the weekend and public holidays will only be processed on the following business day

3.8 If an order cannot be fulfilled in part or in full, the Customer will be immediately contacted by GRACE LIFE.

3.9 Upon receipt of the order details, the user has 3 working days to make the payment. If you do not do so within this period, the order will be cancelled automatically.

3.10 The GRACE LIFE Online Store provides the user with the following payment method: bank transfer.

3.11 Proof of bank transfer must be sent to the e-mail [email protected].

3.12 Payments are received in euro, regardless of the currency in which the transaction is made. Conversion rates for payments made in other currencies must be supported by the Customer.

4. Shipping costs

4.1 The value of the postage is calculated according to the weight of the products, destination, and the total value of the order.

4.2. The value of the postage is indicated in the shopping cart before the final validation of the order, in case of deliveries to Mainland Portugal. For deliveries outside mainland Portugal, the total price of the postage is calculated before the validation of the Customer’s order. 

5. Delivery

5.1 Orders will only be shipped after confirmation of stock and payment and as soon as possible.

5.2 The delivery of the orders will be made to the address indicated by the Customer and according to the delivery times of the carrier. Home delivery cannot be made in P.O. boxes. Deliveries may be made outside mainland Portugal, provided that the address is covered by the carrier’s delivery area.

5.3 As the transport service is contracted to a company, possible delays in deliveries cannot be resolved by GRACE LIFE, and it is not possible, in such cases, to guarantee exact delivery times.

5.4 If for any reason the Customer is not able to receive the order or pick it up at the location indicated by the carrier, the Customer is asked to contact the GRACE LIFE Online Store immediately at the email [email protected].

5.5 All products shipped by GRACE LIFE must be checked at the time of delivery. If the Customer finds that the order is damaged, they must return it immediately to the shipping company, indicate the reason for the return on the packing slip and immediately inform the GRACE LIFE Online Store by email [email protected].

5.6 If after delivery, the Customer finds that any of the items are not in conformity, they are asked to contact GRACE LIFE immediately by e-mail [email protected] indicating the order number or the number of the document that accompanied the order, attaching images of the packaging as received and all items, so that the situation can be resolved as soon as possible.

6. Warranty

6.1. Products purchased from the GRACE LIFE Online Store have a 3-year warranty.

6.2. The warranty shall be provided in accordance with the terms and conditions laid down by the manufacturer of the product concerned.

6.3. After the warranty period, as well as in situations where the warranty is removed due to the verification of a cause of exclusion thereof, the costs incurred in any returns will be on the Customer’s behest, and the Customer is responsible for the conditions of return and transport.

6.4. In order to take advantage of the product warranty, the Customer must keep the invoice delivered at the time of receipt of his order as proof of purchase.

7. Customer Obligations

7.1. The Customer declares to have the necessary legal capacity that allows him to accept these Terms and Conditions.

7.2. The Customer undertakes and undertakes to:

a) comply with these Terms and Conditions and applicable law;

b) provide accurate, true and current data;

c) not use identity other than that of the Customer or falsify or conceal in any way his identity.

d) observe the maximum limits of orders defined in these Terms and Conditions.

e) not to carry out illegal activities or that contra be the rights of GRACE LIFE or its Customers or other internet users.

f) not interfere with or condition, in any way, the use of the GRACE LIFE Online Store or violate any rules, regulations or standards of the networks linked to the use of the GRACE LIFE Online Store.

8. Returns/complaints

8.1 GRACE LIFE Online Store allows you to return products within 14 (fourteen) working days.

8.2 To request an exchange or return, the Customer is requested to contact GRACE LIFE at the email [email protected] indicating the invoice number.

8.3. The return of defective products and wrong shipments is the responsibility of GRACE LIFE, as well as the costs of shipping and collection when the Customer reports this situation within 14 (fourteen) working days from the date of receipt of the product. Once the goods have been received at our facilities and after validation of the condition of the same accordingly, its value will be returned by bank transfer.

8.4 GRACE LIFE is not responsible for deficiencies arising from the Customer’s misuse, negligence, and poor storage conditions.

9. Updating the General Conditions

These general conditions of sale online may be changed without notice and must therefore be consulted before placing any order.

10. Data Protection

The Customer must expressly declare that he authorizes the collection or updating of his contact details, for integration in GRACE LIFE files for the purpose of Customer management, business relations, as well as for sending advertising about products and services pursuant to Decree-Law No. 6/99, Law No. 41/2004 and Directive No. 2002/58/EC, automated processing, and profiling, by all available communication channels, including electronic means. Express consent must be made at the time of registration in the GRACE LIFE Online Store, in the option indicated there for this purpose. The contact details collected shall be kept for the period in which the purpose for which its processing was consented is found, or until the right of opposition, rectification, and erasure of the same is found. The data subject has the right to access the retained data free of charge, as well as to request its limitation, rectification, opposition, or payment when, among other legal grounds, the contact details are inaccurate or are no longer necessary for the purpose that motivated their collection. The holder also has the right to withdraw his consent at any time, without compromising the lawfulness of the processing carried out based on the consent previously given. If technically possible, you can request the portability of your data to another controller, in this case they will only be kept for the exercise or defense of complaints. When exercising some of the above rights, we reserve the right to retain the data solely for the purposes of the declaration, exercise or defense of a right in judicial proceedings. For the exercise of these rights or other additional questions you have regarding data protection, you may contact GRACE LIFE in writing at Avenida Rei Humberto II de Italia, no. 17, 4º D42 2750-642 Cascais; or, through the email [email protected] and must authenticate and prove the identity of the data subject. We also inform you that you may file a complaint with the National Data Protection Commission in case you consider that your rights have not been properly addressed. For more information you can consult: GRACE LIFE does not transfer the contact details collected to third parties. If there is a legitimate basis for its transfer, the Customer will be informed in advance, being transmitted to him the identity of the recipients and the purpose of the processing of the data transferred. The transfer takes place only when third parties provide sufficient guarantees for the implementation of appropriate technical and organizational measures, so that the processing meets the requirements and obligations arising from applicable data protection legislation and ensures the protection of the rights of the data subject.

11. Statement of Responsibility

GRACE LIFE expressly declares and warrants that:

a) Will treat adequately the Personal Data that it collects from its Customers in connection with the provision of the GRACE LIFE Online Store service; whereas they shall be treated lawful and confidentially, loyally and transparently, and in a manner that guarantees their security, in particular by obliging to protect such Personal Data from accidental or unlawful destruction, accidental loss, alteration, unauthorized dissemination or access.

(b) Is able to ensure all appropriate technical and organizational measures in such a way that the processing of Personal Data meets the requirements of the current Personal Data Protection Act, adopted by Law No 67/98 of 26 October and Regulation (EU) 2016/679 of the European Parliament and the Council of 27.04.2016, (“GDPR”).

c) The Personal Data is intended only for the execution of orders placed in the GRACE LIFE Online Store, being collected only those necessary, appropriate, relevant, and limited to this purpose.

d) You will keep personal data accurate and up to date.

f) You will not use personal data to which you have access for any purpose other than that provided for in these Terms and Conditions.

g) At the request of the Customer will destroy such Personal Data immediately and efficiently.

12. Online Store maintenance

12.1. GRACE LIFE undertakes to make access to the GRACE LIFE Online Store available on a regular and continuous basis, except where this is not possible for reasons of unforeseeable overload of distribution networks and/or computer systems on which it is supported, or due to situations of force-large (situations of an extraordinary or unpredictable nature, GRACE LIFE and which cannot be controlled by GRACE LIFE), in which cases GRACE LIFE may not guarantee its operation at 100% and during the 24 hours of the day, and also undertakes, in case of interruption, to regularize the situation as soon as possible.

12.2. GRACE LIFE does not warrant that the GRACE LIFE Online Store will operate uninterruptedly or that it is free from errors, viruses, or other harmful elements.

12.3. GRACE LIFE undertakes to restore access to the GRACE LIFE Online Store as technically possible, whenever there are malfunctions of its liability that cause interruptions in the availability of access to it.

13. Suspension of the Online Store

13.1. GRACE LIFE reserves the right to suspend or terminate access to the GRACE LIFE Online Store, as well as to request confirmation of any information provided by the Customer.

13.2. GRACE LIFE reserves the right to take all measures it deems necessary to safeguard its rights in the event of infringement or attempted infringement of these Terms and Conditions and may choose to suspend or block access to and use of the GRACE LIFE Online Store, without the right to you to any compensation or compensation for this fact.

14. Intellectual Property

The GRACE LIFE Online Store is a website registered by GRACE LIFE and the services provided through it are your responsibility. All trademarks, logos and symbols used in the GRACE LIFE Online Store are the property of GRACE LIFE or GRACE LIFE has obtained the competent authorization to do so.

15. Applicable law and Court

15.1. All matters not expressly regulated in these Terms and Conditions shall apply to Portuguese Law.

15.2. In the event of a dispute regarding the validity, effectiveness, interpretation, integration, application or compliance with these Terms and Conditions, GRACE LIFE and the Customer agree that it be submitted to the exclusive jurisdiction of the District Court of GRACE LIFE’s company headquarters, expressly waiving any other.
